1. Introduction
Welcome to Jetaviews (“Jetaviews”, “we”, “us”). These Terms govern your access to and use of our website, apps, dashboards, and related services (collectively, the “Platform”).
By accessing or using the Platform, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Platform.
2. Definitions
- Brand: A business user that creates and funds campaigns.
- Creator: An individual or entity that publishes content for campaigns.
- Campaign: A project with a brief, milestones, CPM, budget, and rules.
- Verified Views: Views that pass our verification and anti-fraud checks.
- Milestone: A threshold (e.g., per 1,000 Verified Views) that triggers payout.
3. Platform Overview
- Brands create campaigns and fund a budget held by our payment partners (escrow-like flow).
- Creators apply and, upon approval, post content per the brief.
- When milestones are reached with Verified Views, payouts are released automatically.
- Unused budget is returned to the Brand at campaign end per these Terms.
We are not a bank, investment, or employment service. We facilitate payments via third-party processors.
4. Accounts & Eligibility
- You must be at least 18 years old and have capacity to contract.
- Provide accurate, current information; keep credentials confidential.
- We may require verification (e.g., ID, tax info) and may approve/deny at our discretion.
4.1 Creator Onboarding
To unlock full access, Creators must complete onboarding by posting a Jetaviews promotional video and reaching 3,000 verified views. Anti-fraud checks apply.
5. Payments, Fees & Taxes
5.1 Brands
- Minimum campaign budget: €350. Budget is pre-funded via our payment processor.
- Funds are released to Creators as milestones are verified.
- Unused budget is refunded at campaign completion (maximum campaign length: 3 months), minus applicable fees or chargebacks.
5.2 Creators
- Creators receive 85% of Brand-set CPM per 1,000 Verified Views; Jetaviews retains 15% as platform fee.
- Payouts are processed within 7 days after milestone verification, subject to compliance checks.
- Content must remain public and compliant for at least 30 days unless the brief states otherwise.
5.3 Subscriptions & Billing
- Where applicable, subscriptions renew automatically until canceled in-app.
- Unless required by law, subscription fees are non-refundable once the billing period starts.
- You authorize us to charge your payment method for fees, taxes, and adjustments.
5.4 Chargebacks & Offsets
We may pause, offset, or claw back amounts in case of disputes, fraud, chargebacks, or violations.
5.5 Taxes
You are responsible for any taxes arising from your use of the Platform (e.g., VAT, income tax). We may collect and remit where required.
6. First-Month Creator Guarantee
Eligible Creators who post at least one approved campaign video within 30 calendar days after account unlock receive a top-up to €100 if their verified earnings are below €100. One-time benefit. Subject to anti-fraud checks, compliance with briefs, and content remaining public for the required period. We may deny or reverse the guarantee in case of abuse.
7. Content Rules & Disclosures
7.1 Prohibited Content
- Illegal, infringing, deceptive, hateful, or violent content.
- Violations of TikTok/Instagram policies or local advertising laws.
7.2 Sponsorship Disclosure
Use clear labels (e.g., #ad, #sponsored) and comply with all applicable advertising and consumer-protection rules.
7.3 Moderation & Takedowns
We may remove, refuse, or require edits to content or campaigns at our discretion (e.g., non-compliance, safety, IP concerns).
8. Verification & Anti-Fraud
Only organic, Verified Views count. Disqualified traffic includes bot/fake engagement, disallowed paid boosts, private/non-public posts, deleted content, and other manipulations. We use automated and manual checks (rate limits, anomaly/duplicate detection, boost detection). We may pause or reverse payments for suspicious activity.
9. Campaign Terms
- Duration: Up to 3 months unless agreed otherwise in the brief.
- Cancellation: Brands may cancel before content approval; after approval, payouts follow milestones.
- Brief Prevails: If the brief conflicts with these Terms, the stricter requirement applies unless expressly waived by us.
10. Intellectual Property & Licenses
- Creator Content: Creators retain ownership. By submitting to a Campaign, you grant the Brand a non-exclusive, worldwide, royalty-free license to use, reproduce, and display the content for the campaign duration and any period stated in the brief.
- Brand Assets: Brands grant Creators a limited license to use brand assets solely to create campaign content per the brief.
- Platform License: You grant Jetaviews a license to host, cache, analyze, and display campaign-related content and metrics to operate the Platform.
- Trademarks: Use of any party’s marks requires permission or brief authorization.
11. IP Complaints
If you believe your IP rights are infringed, email contact@jetaviews.com with details (work, URL, proof of ownership, contact info). We may remove or disable access to disputed material and notify relevant users.
12. Disclaimers
The Platform is provided “as is” and “as available.” We do not guarantee specific results, view counts, distribution, or uptime. Platform algorithms and third-party services may change without notice.
13. Limitation of Liability
To the maximum extent permitted by law, Jetaviews will not be liable for indirect, incidental, special, consequential, or punitive damages, lost profits, or loss of data. Our total liability for any claim in any 12-month period is limited to the greater of €100 or the amounts you paid to us for the service giving rise to the claim during that period.
14. Indemnity
You will defend, indemnify, and hold harmless Jetaviews from claims arising out of your content, conduct, campaigns, or breach of these Terms.
15. Automated Decisions
We use automated checks (e.g., fraud detection) that may affect eligibility or payouts. You may request human review via contact@jetaviews.com.
16. Service Changes; Force Majeure
We may modify or discontinue features at any time. We are not liable for delays or failures caused by events beyond our reasonable control, including outages of third-party platforms (e.g., TikTok, Instagram).
17. Suspension & Termination
We may suspend or terminate accounts for breaches, fraud, or misuse. Upon termination, licenses end except where survival is stated, and accrued payment obligations remain due.
18. Governing Law & Disputes
These Terms are governed by Dutch law. Courts of Rotterdam, Netherlands have exclusive jurisdiction, except where overriding consumer law applies.
19. Miscellaneous
- Notices: We may notify you in-app or via email.
- Assignment: You may not assign these Terms without our consent; we may assign to an affiliate or in connection with a merger/sale.
- Severability: If a clause is unenforceable, the remainder stays effective.
- Entire Agreement: These Terms + briefs + referenced policies form the entire agreement.
- Survival: Payment, IP licenses (as stated), disclaimers, limitations, indemnity, and governing law survive termination.
20. Changes to These Terms
We may update these Terms from time to time. Material changes will be notified in-app or by email. Your continued use after the effective date constitutes acceptance.
